"MARATHON FITNESS TRAINING CENTER TERMS & CONDITIONS 2023 ACKNOWLEDGEMENT OF RISK & RELEASE OF LIABILITY As a client, you assume all risks, responsibility, and liability of participation regardless of the number or type of session. Coach Peters/Marathon Fitness/MFTC/volunteer assistants are released and held harmless of any and all liability, claims, demands, actions, lawsuits or rights of action, injury, released from payment for any pre-existing injuries, released from action related from past, current, and future injuries, and/or resulting in death. YOUR CONDUCT Bring your mat, water, and a towel. Your clock will start at your designated time. Warm-up (5-10 min) and end-of-session stretch (5 min) are on your own. You need to be prepared to work with any of the assistants for any reason. Proper athletic attire, athletic supports, and/or footwear must be worn at all times unless stated Be on time There are no children allowed in the facility unless they are a paid client Chewing gum is not permitted; cell phones must be used by the lockers Do not ask to try a machine or an extreme exercise Do not send Coach Peters or the team exercise or class ideas. Refrain from discussing intimate matters that do not impact your training If you don’t feel well or you have not eaten, you will be sent home w/o rescheduling. CONTENT Your content will be any combination of exercises using specialized equipment, weight lifting, resistance training, and body weight that are typically not done at home or at a commercial facility. Your schedule will appear on the app calendar. Total Body content will be timed exercises. Lift content will be a combination of standard, complex/compound, and barefoot exercises. Mobility/flexibility content will be based on recovery/soreness (shoes optional; this is not rehab or therapy). COMMUNICATION All communication (messages & video chats) is done on the app. If you need to cancel for work, school, kids, etc., just send “cancel today” within 1 hour of your time slot. If you need to cancel for ANY medical reason, please let Coach Peters know immediately. “I’m sick but it’s not covid” is not sufficient. Vacation/travel absences need to be discussed in advanced. SUBSCRIPTION SESSIONS/WK RESCHEDULES PER MONTH >Split 1 in-house/1 live stream None >Functional 2 (low/medium impact) 1 >Premium 2 (medium/high impact) 1 >Challenge 3 w/nutritional guidance 2 >Lifestyle 4 w/nutritional guidance 2 *Virtual is no longer offered *Subscriptions have set times for consistency; no same-day requests *Reschedules must be requested at the time of your cancelation and completed within 72 hrs *You cannot reschedule a “reschedule” *Changing your subscription requires a video chat TEAM CONDUCT Greeting you upon arrival (no “mushy” talk) Starting your session with the appropriate instructions Moving through each exercise in each block with a short demo Applying short adjustments w/o stopping your progress Checking for your understanding in a positive manner Gauging if you can do a little more Modifying an exercise until you’re ready to execute at a standard level Taking detailed notes & regular evaluations The MFTC team will not give any medical advice. Gratuities or gifts will not be accepted during business or in exchange for goods or services. Coach Peters do not celebrate holidays and will not accept any of gratuities or gifts in any form. SINGLE SESSIONS (Ryde, BoxFit, & Climb) Single sessions must be booked on the app, unless you have a subscription. Subscriptions holders must request to be added for BoxFit or Ryde the day before the session. Please review the session requirements prior to your request. Please do not send a message that you cannot attend; you cannot arrive late. PAYMENTS/FEES Payments are processed by Stripe (in-house equipment and water). You will receive a reminder 3 days before your subscription renews. If your payment has failed, Stripe will automatically reprocess within 12 hr. If your payment fails a 2nd time, your account will be deactivated and you will be removed from the both apps. Arbonne supplements and special sales are done on Cash App only (no cash/no exceptions). Change/add credit card: $5/request No-show fee: $10/session Cancelation of subscription for any reason: $30 WINTER MASK POLICY (NOV-JAN) MFTC team members will wear a mask while training or teaching (Nov – Jan). Clients will have the option of wearing a mask. Mask will not be provided but you may purchase a mask support for $2.00. Hand washing will remain a requirement. Team members will handle the prep/cleaning of equipment. Please continue to give one another the necessary space & time when entering and exiting. Please continue your level of transparency (travel, illness, injury) COVID TESTING Missing sessions due to illness requires a negative time-stamped test to return. Travel within the United Sates will require a one-day waiting period along a negative time-stamped test the day before you return to training. Traveling outside of the United States will require a 2-day waiting period along with a negative time-stamped test the day before you return to training. This is non-negotiable regardless of how it impacts your training. PRIVACY/SOCIAL MEDIA All of your information (including but not limited to calls of any form, messages, notes, content, plans, conversations, and any disclosures) will remain private. Credit card information is not store by Marathon Fitness/MFTC in any manual form. Upon registration, you give MFTC and Stripe access and authority to charge your card for any purchase. Your image and/or likeness may be used on social media in a positive. If you do want us to use your image please let us know. No one will be discriminate against on the basis or religion, gender, race, ethnicity, sexual orientation, or ability. NO REFUNDS No refunds, rollovers, or credits of products, sessions, services, or subscriptions (regardless of form of payment) towards any other product, session, service, or subscription, regardless of time, situation, conditions, reason, including, but not limited to Acts of God, government restrictions, wars, insurrections, communicable diseases/pandemics, natural disasters, such as earthquakes, hurricanes or floods and/or any other cause beyond reasonable control. GROUNDS FOR ADMINISTRATIVE DISMISSAL W/O RETURN Failing to disclose/failing to with any communicable disease protocols Failure to communicate injuries/illnesses Failed payment Repeated cancelations and/or inconsistent attendance Poor attitude and complaining Extreme physical limitations Repeatedly making special requests or disruptions (checking your phone, music, etc.) Being under the influence and/or smelling like/use of a foreign substance regardless of legality Not maintaining proper hygiene Student-athletes and teams have a different form to be signed upon attendance.
